In recent years, the United States has witnessed a concerning surge in anti-LGBTQ+ legislation. According to data from the American Civil Liberties Union (ACLU), 2023 has seen the introduction of over 491 bills targeting LGBTQ+ rights in state legislatures, with a staggering 62 bills already passed into law – a record-breaking figure. These numbers reflect an alarming trend of discrimination and prejudice against the LGBTQ+ community. This blog post aims to shed light on the variety of anti-LGBTQ+ legislation introduced or passed this year and explore the potential implications of these laws.
Banning Gender-Affirming Care for Trans Youth (and Beyond)
Among the most controversial topics within this wave of legislation is the restriction or outright banning of gender-affirming care for transgender youth. Despite support by renowned medical associations such as the American Medical Association, the American Academy of Pediatrics, and the American Psychological Association, several states, such as Arkansas, Alabama and Utah, have passed laws prohibiting these essential medical procedures. Even more concerning, some laws extend beyond age limits, such as in Oklahoma, where gender transition-related care has been banned for anyone under the age of 26, and Medicaid coverage for gender-affirming care has been prohibited.
Targeting Drag Shows and Public Performances
Another disheartening trend is the introduction of laws aimed at outlawing drag shows and public performances. Tennessee, for instance, passed a law banning public drag performances, while several other states, including Texas, Missouri, and Arizona, have advanced similar bills. Such legislation not only threatens the vibrant and diverse drag culture but also potentially criminalizes any transgender person who publicly expresses their gender identity.
Bathroom Bills and Sports Bans
The issue of bathroom bills has resurfaced in 2023, with states like Iowa and Idaho enacting laws that restrict transgender students from using school bathrooms aligned with their gender identities. Moreover, bans on transgender youth participating in school sports have emerged in 21 states, with 67 bills related to transgender athletes under consideration in 27 states. These measures not only perpetuate discrimination but also marginalize transgender youth and impede their full participation in educational and athletic activities.
Speech Restrictions and Book Bans
Another concerning trend is the targeting of speech and written material involving sexual and gender orientation. Legislators have been heavily involved in regulating curriculum in public schools, including discussions around gender identity and sexuality, with several states passing laws prohibiting classroom discussions about sexual orientation and gender identity. Florida's Parental Rights in Education law, also known as the "Don't Say Gay Bill," prohibits such discussions, potentially erasing LGBTQ+ voices and experiences from educational environments. In some cases, laws require schools to notify parents when a child uses a different name or pronoun or undergoes a gender expression change. Additionally, laws targeting written speech involving sexual and gender orientation have resulted in record numbers of book bans in libraries across the country, with a significant portion of the top challenged books containing LGBTQ+ content.

As anti-LGBTQ+ legislation increases, it becomes clear that their impact is felt most strongly at the state level. While national politics often dominate public attention, it is crucial to recognize the importance of local elections and engagement. By actively participating in state-level organizations that fight against discriminatory legislation, we can work towards creating a safer and more inclusive nation for all.
